Has child pornography ever been found in Michael Jackson’s possession?

No.

The possession of child pornography is a federal crime and had there been any found in Jackson’s possession he would have been charged and convicted on that alone. Police extensively searched Jackson’s premises and those of people around him, both in 1993 and in 2003 and nothing illegal was found, not in physical or digital format (ie. on computers).

Despite the fact that investigators acknowledged that “the search warrant didn’t result in anything that would support a criminal filing” (Los Angeles Times, August 27, 1993), in the media the prosecution tried to bolster their case by attempting to refer to two legal art photography books from the 1960s, found at Neverland during the 1993 investigation, as “child erotica” because they included pictures of nude boys at play. One book, entitled The Boy: A Photographic Essay, contained pictures of boys in various situations by different photographers, including photos taken during the filming of a 1963 Lord of the Flies movie and showed the boys on the set, usually clothed but sometimes nude, playing in the sand, reading comic books, and having pillow fights. It was a gift Jackson had received from a fan; the inscription inside read: “To Michael: From your fan, “Rhonda” ♥ 1983, Chicago”. The other, entitled Boys Will Be Boys, included photographs of boys, some naked, in various non-sexual activities such as climbing trees or sitting on benches, it had an inscription inside by Jackson himself and it read: “Look at the true spirit of happiness and joy in these boys’ faces. This is the spirit of boyhood, a life I never had and will always dream of. This is the life I want for my children, MJ.” These books were shown to the jury at Jackson’s 2005 trial and to the two Grand Juries which failed to press charges against Jackson in 1994.

These two books were a small portion of Jackson’s huge collection of art photography books, as he was an avid collector of books, especially art books, photography books and vintage books.

Jackson had a two story and three bathroomed bedroom at Neverland, here are photos depicting Jackson’s bedroom in the 1993 raid and in the 2003 one, the boxes downstairs are where almost all of the books depicted here were found:

Judge Melville also allowed the prosecution to introduce a few art books and a large amount of adult magazines into evidence [1] [2] [3]. The art photography books confiscated in the 2003 search were introduced because some of them included pictures of women and/or men partially clothed or nude. The prosecution would claim in their motions that many of the books featuring male nudity contained “teenaged” or “young” males, though they meant males above the age of 18 who they judged to look young.

The majority of these books were found in big cardboard boxes among hundreds and thousands of art and photography books in the downstairs area of his bedroom, others were found in Jackson’s libraries, others were sent in to Jackson by photographers who had worked or were seeking to work with Jackson or had been sent in by fans, and the prosecution would admit they could not tell if Jackson had even seen or opened many of them. Jackson owned over a million books, much of them in storage, and there were about 10,000 books in total in the areas of Jackson’s home where the Santa Barbara police had focused their search. Sneddon would attempt to downplay the number of books Jackson owned [Sneddon closing statement], but their own detectives would testify that there had been thousands of books in the areas that they had searched and that it had not been possible to count them all. According to people who knew Jackson, he was a “prolific” “voracious” reader who would frequently spend thousands of dollars at a time in bookstores, here is a list of other books Jackson owned:  Michael Jackson’s Favorite Books.

Jackson also had an extensive interest in photography and had done so since he was a child.

CBS executive Ray Newton spoke about having met Jackson in 1979 and discovering how well versed Jackson’s love for photography was back then:

About an hour later we picked up the professional photographer who was coming with us to radio. The photographer gets in the front seat of the limo says hello and then starts to assemble his camera. Once his camera is assembled he points it at me and Michael in the back seat of the limo. I instruct him not to shoot us so Michael can relax. Looking back, that would be a cool photo to have now but I was looking out for Michael’s well-being. Michael sees the camera and starts this deep photography discussion. I was in the discussion for about a minute then it got so deep that I just dropped out and that’s when the photographer looked at me and I looked at him with the looks saying check this out – Michael Jackson is knee deep in photography discourse. I asked Michael if he was a photographer and he said “No, I just like photography!!!”.

So Michael continues engaging in this very deep photography conversation with the photographer where he mentions something that the photographer said he needed to look into further. This went on for about 5 minutes, and the only thing that stopped that topic was that the photographer said something that Michael didn’t know and Michael got quiet.

Let me translate how deep Michael’s photography discussion was: imagine if someone says in the middle of a general conversation – pataflaflas swiss 6 accented parafliddle lesson 25 around the set groove. You would not only have to be a drummer but a drummer with not just a knowledge of rudiments but an advanced knowledge of rudiments that one can apply and play around the drumset and make them groove to know what that person was talking about.

Michael would also use photography books as the inspiration for some of his costumes. Michael’s long time guitarist Jennifer Batten said her HIStory outfit had been inspired by something someone had shown him in an S&M book:

“Somebody had shown Michael an art book that was kind of S&M based and all the paintings looked really beautiful. So he had that in mind but when it came to real life it wasn’t too beautiful anymore,” she laughs. “I just had to remind myself that it was all about the theatre, you know? It’s not just about the music.”

Photographer Todd Gray who worked with Jackson from 1979-1982 said of Jackson in his book Before He Was King:

“When Michael did find time to relax, he loved to leaf through photographic picture books. He would bring his favorite books with him on tour and buy more books while on the road – the bus weighted with an increasing number of boxes as we left each city. The Triumph Tour began in Memphis with no boxes; by the time we got to Dallas, a few days later, I noticed two; then came Houston; and by the time we hit San Antonio, I noticed a score of boxes being loaded onto the bus. He especially loved books on Hollywood glamour from the 1930s, richly illustrated children’s books, and coffee-table books on photography. Michael would usually hole up in the rear of the bus, while the others spent their time together in front. I also preferred the quiet at the back, and I would sit down with him while he was engrossed in a book of Hollywood glamour photographs from the 1930s. Looking at a particularly striking photo, he would say, “This is magic. They don’t make photos like this anymore.” He studied the pose, eyes, make-up, and expression – everything that went into a great glamour photo.

Michael also loved books that showed children from around the world. One day on the bus I remember him saying “I wish I could write a book about the children of the world. I could go to every country and show how everyone on earth is beautiful. I want to go to India and show the poverty and suffering of the children there, and maybe I could help improve the situation. Africa, too, where there is so much starvation and disease. Todd, would you want to do that with me?” I was stunned, both because I wondered how Michael would ever find the time and also that he wanted me to be the photographer. I suggested that he take a look at the photographs of Lewis Hine, the influential photojournalist whose work helped spur the introduction of child labor laws in the early twentieth century.”

After this conversation it seems Michael had looked into Lewis Hine’s work and 30 years later would tell people about it himself, even referencing it in his work. Bernt Capra who worked with Michael before he died on This Is It said in 2009:

“Michael Jackson was very well read and he loved art, and he knew his photography, and he liked this photographer, Lewis Hine, who had been a social worker in the depression era and shot photographs of victims of child labor – four, five, six year olds working in mills and mines. He was also very well known for a collection of photos of the construction of the Empire State Building which are very valuable now. Michael loves this guy and he based “The Way You Make Me Feel” choreography and set design on the photos of the men constructing steel beams as if they were on the top of a skyscraper having a lunch break.”

The photographers that contributed to the collection were American and European and included Hajo Ortil, Karel Egermeier, Ermete Marzoni, Jos Le Doare, and others.

I was a personal friend of Charles that died in 1974 at age 65. I have most of his cameras used during his professional career. I do not own a copy of this book, but have seen it at Lib of Congress. It is NOT smut, but great photography. Charles told me he had the parents in room or area while he was photographing the children. It was with parents permission or request. Back in 30s & 40s Charles operated a Biedler-Viking 5X7 child portrait camera that I now have one of 3 patented & made. He took many stereo photos (I have a few)that included military big gun repair photos for a stereo manual. He also took Vectographs ( 3d type of photos) for Polaroid

He lived in Agawaum, MA and had several local displays of his work. He liked to get the entire family involved in a photo, including many nude shots of children with parents present while filming. The book has several topless young girls. It is NOT SMUT!

He was actively exhibiting: 1934 at Princeton Camera Club, 1943 New York City, 1954 Pittsfield. There could easily have been a dozen others.

Starr Ockenga won national acclaim for her first book on gardens, Earth on Her Hands: The Amerian Woman in Her Garden, which received an American Horticultural Society Book Award for 1999. She continued to document American gardens with Eden on Their Minds: American Gardeners with Bold Visions, published in 2001. Her work has appeared in numerous national publications, including Horticulture and Country Home. She received her master’s degree in photography from the Rhode Island School of Design and has been granted fellowships from the National Endowment for the Arts and the Massachusetts Artists Foundation. Her photographs have been exhibited in museums and galleries across the United States and abroad. Kelly Klein has been involved in the fashion industry for over 25 years. After she graduated from FIT in New York she worked as an assistant designer to Ralph Lauren and then as an assistant designer to Calvin Klein. After leaving the fashion industry, Kelly started her photography career. She has worked for numerous magazines such as British Vogue, German Vogue, French Vogue, Russian Vogue, Italian Marie Claire, Harper;s Bazaar, Interview, Jane and A Magazine. Kelly has also shot advertising campaigns for Bacara Hotel, Park Hyatt Hotel, and Sam Edleman Shoes. Profile on the artist:

The quest for the right place to make art has taken photographer and painter John Patrick Salisbury from northern California to Los Angeles to New York and finally to rural Louisiana. His search for art-making supplies, however, often takes him to Home Depot.

Though he first made a name for himself with conventional black and white photography—including a haunting study of his two young cousins collected in the 1996 book “Drew and Jimmy”— Salisbury’s subsequent work is remarkable for its refusal to stand still, moving through an evolution of modes, techniques and materials.

Today, his photography (see p. 69) is defined by large panels, often three or more making up a single image, all attached to special display brackets Salisbury designed himself to hold the works out from the wall and add another dimension of light and space to the work. Meanwhile, his painting takes an abstract turn with themes of fluidity and topography using multiple layers of texture. Urethane is a key material, as are epoxy, wood glue, wax, seeds, nails, plaster, tape—even insects that might
land on a wet surface.

“The photography is very demanding, technically and with all the materials involved,” Salisbury says. “So the painting is a reaction to that. It can be total chaos. I go to the hardware store and grab whatever I want and do it.”

Raised on a working farm in Walnut Grove, Calif., Salisbury was interested in art from a young age but decided to make a life of it after the car accident that killed his younger brother Burton. His brother’s memory was the inspiration for “Drew and Jimmy” and the book opened many doors for him to professional photography.

In Los Angeles, he landed jobs photographing celebrities and shooting album cover art, including one assignment for the debut album of the then-unknown singer Alanis Morisette.

Salisbury moved to New York but craved more room and a more lush setting as his work grew in scale and scope. He and his young family bought a home in Folsom the summer before Hurricane Katrina.

“Coming to New Orleans was like a dream come true. I had an immediate affinity for this place, more than I’ve ever experienced anywhere else,” he says.

While he continues painting, Salisbury’s photography has entered a new phase with a concept he has dubbed DM4/Convergence, with large panels of photographic images positioned in a variety of angles with each other to make a complete work. He takes a philosophical approach to the format, describing the components as different planes of reality intersecting each other.

Rineke Dijkstra has a gift for capturing the underlying humanity in her portrait subjects with a simplicity and innocence that is rare even among top photographers. Beach Portraits shows a sample of this skill in a series of photographs that, at first glance, are composed in a very straightforward manner; the nuance of her composition lies in the elevation of the camera to capture the portrait: mostly at belly button height. This lends a sense of power to the subject without making the subject overpowering; the subtlety of the effect brings balance to the overall image between innocence and being somewhat self-possessed.

The narrative in this book provides an in-depth explanation of Rineke Dijkstra’s approach, as well as the method of displaying the final prints in exhibition. One may not have seen the images first hand, but through this book the emotion of the images is conveyed effectively.

Highly recommended for the serious student of photography.

Jackson’s costume designer Michael Bush confirmed this inspiration in his book The King of Style:

Michael wanted to appear futuristic but was opposed to space suits or astronaut helmets because they bulked him up too much and were incapable of enhancing his body or choreography. Inspired by the Dancing Machine video the Jackson 5 did in 1973, which included a provocative female robot as the “dancing machine,” Michael said, “I want a sleek piece of chrome that I can dance in head to toe.”

For inspiration Michael lent us a collection of books showcasing the work of Japanese artist Sorayama, who had designed an organic robotic form, which ultimately became the famous “AIBO” dog, now in the collection of the Museum of Modern Art and the Smithsonian Institute of Technology. Sorayama had made his mark in ht elate 1970s with the creation of female robotic figures that were anatomically correct in form but appeared to have been fashioned from molten silver. The term “sexy robot” was coined to describe them. Dennis and I knew if we could make Michael look like he had a second skin made of metal, like Sorayama had done with his sexy robots, we would not only have reached the next, we would have surprassed it.

Hajime Sorayama is a Japanese illustrator, known for his precisely detailed, erotic airbrush portrayals of women and feminine robots.

Sorayama’s work Sexy Robot, published by Genko-sha in 1983, made his organic robotic forms famous around the world. For the work, he used ideas from pin-up art, which in the book then appear as chrome-plated gynoids in suggestive poses. His next book, Pin-up (Graphic-sha, 1984), continue in the same line. A number of his other works similarly revolve around figures in suggestive poses, including highly realistic depictions in latex and leather. His pinups appeared monthly for in the pages of Penthouse magazine and Playboy TV made a special show on Soryama arts. The period from 2000 to 2012 has included Sorayama’s organic design of Sony AIBO robotic pet dog co-winning (with Sony) Japan’s Grand Prize of best design awards (the highest design award conferred by Japan); Sorayama’s Sony AIBO robotic pet design was placed into the permanent collections of MOMA and the Smithsonian Institute Museum; MOMA’s published book “Objects of Design” by Paola Antonelli included Sorayama’s and Sony’s AIBO along with other noteworthy designs where form and function combine in harmony. AIBO is the first ever artificially intelligent robot pet. The NIKE “White Dunk Project” included Sorayama arts within 25 most inspiring Japanese artists.

In 1985 Sorayama published the video Illustration Video,[3] his first work apart from the books of illustrations. Nudist magazines from this time period are very collectible and can reach upwards of $500 or more on auction sites.

Michael wasn’t shy about his interest in photos of women from nudist magazines and had in fact openly purchased some just a few years earlier while shopping at Recycled Records Store sometime circa 2000:

Boone’s original magazine, The Nudist, debuted in 1933, just about the time young Connie was learning to swim. It was a serious, philosophical magazine, much like the early German journals, but America was not Germany, and to keep his distribution Boone was forced to obscure the genitals in his photographs. A few years later he changed The Nudist’s title to the less confrontational Sunshine and Health, but the airbrush stayed busy.

Boone was known as The Dictator in nudist circles. He loved to preach and he loved to fight—as long as he won. He confronted the courts over and over on the issue of censorship, demanding the right to display the naked human body—every dangling bit of it—in his magazine. In 1941 the government resurrected the Comstock Law, a Victorian law that prohibited sending obscene material through the mail, in an attempt to defeat him.

It only enraged him. Through the ’40s and ’50s “Uncle Danny” fought for pubic hair. On January 13th, 1958 he won. Nudist magazines were judged to be nonsexual, and therefore not obscene; they could travel through the mails and show what no other American magazines could: full frontal nudity. New magazines sprang up like violets after a spring rain.

In 1965, the United States government decided to get Milton Luros. His girlie magazines, tame by today’s standards, were considerably more explicit than anything else on America’s newsstands. The tool then used to trip up purveyors of obscene materials was the Comstock Law, but because Milton owned his own distribution company and moved his magazines in his own trucks there was little chance to snare him with the mails. Thus a trap was laid with the help of a news dealer in Iowa who persuaded American Art to send him several titles via the US postal service. Luros was subpoenaed and ordered to stand trial in Sioux City, buckle of America’s conservative Bible Belt. It was not exactly a jury of his peers.

Again from Talese’s Thy Neighbor’s Wife, the trial “lasted three months, was heard by a cranky judge and a jury that consisted almost entirely of farmer’s wives.” Luros was convicted of conspiring to disseminate obscenity, but the government hadn’t figured on the zeal of Stanley Fleishman, Milt’s first amendment lawyer. Fleishman, horribly crippled from childhood polio and shy with women, understood the necessity of erotic literature and devoted his life to fighting for its legalization. He took Luros’s case to the highest federal court and got the conviction overturned.

In late ’65s, Luros returned to North Hollywood fearing nothing and nobody. He’d beaten the government and set a national precedent against censorship.

“Before the Iowa case,” says Jaybird designer Steve Goldenberg, “I spent a lot of time airbrushing out pubic hair. After, I was airbrushing it in.”

One must remember that most Americans of this time had never seen pubic hair in print. Every nude outside of nudist magazines had her pubic region airbrushed smooth and featureless as a mannequin’s. In my collection I have magazines of this period in which the original owners carefully drew in public hair to make the models more realistic. All this denial of simple, normal female anatomy made many men desperate for images of natural pudenda. Reitman was one such man, and Jaybird was the vehicle to satisfy his desire.

“I first met Michael Jackson in the late 70s. Andy Warhol asked me to photograph a group of kids called the Jackson Five for Interview Magazine”
They were staying with their tutor while on tour at a hotel in mid-town New York City. Their tutor was an elegant lady – almost like a character out of a George Cukor’s film, The Women. When I started taking the photographs, Michael and his brothers were having a pillow fight, and she was trying to make them behave like gentleman. Michael wasn’t posing; he was only interested in reading the newspaper and looking for his reviews.
That was almost 30 years ago, and since then I’ve had the chance to know his charming sister Janet and shared good friends like Muhammad Ali’s manager Bernie Yuman, the film director Brett Ratner and a lady who is beyond description, Elizabeth Taylor.
For years Michael and I have talked about taking photographs, but it never happened again until now, because our busy lives kept us at different ends of the globe. Luckily this time, we both found ourselves in New York City at the same time. I wanted to photograph Micheal instead of sending him a thank you note explaining all the joys I’ve had listening to him sing and watching him dance. Each of these times were marked as celebration in my crazy life: falling in love, driving my dream car, getting a new dog, photographing my family, or hanging out with a friend over a few beers. If I had to count how many times Michael’s music has given a life to my photographs, that number would be in thousands. Because of the music’s rhythm and soul, I would end up taking so many photographs that I would run out of film and all my cameras would break down.
So Michael, accept my gratitude for you have a big place in a lot of people’s hearts. As they say on the street “Michael’s in the house and lets just do it!” – “Lets just get down and take some pictures and see if we land once again on the moon.”

For over a century the art photographs of Wilhelm von Gloeden (1856 – 1931) have been admired and collected, maligned and banned, and have generally been a landmark in the study of the male nude in art. This small (in size) volume of the artist’s photographs represent all the photos taken in Taormina, Sicily, a near mythical spot where artists have flocked for many years. von Gloeden originally moved to Taormina on physician’s orders, leaving his homeland of Prussia and his successful career as an actor for the warmer, healthier climes of Sicily. While there, he gradually converted his home into a backdrop where he could use his camera to captured Sicilian youths in staged, classical poses – an homage to Greek and Roman myths and times. The book’s Introduction is by Roland Barthes who states ‘He mixes nudity and truth, natural phenomena and essence. These little Greek gods have peasants’ hands, hardened feet… clearly visible foreskins which are unstylized, that is, not slenderized and tapered: our attention is drawn to the fact that they are clearly uncircumcised. The baron’s photographs are at the same time sublime and anatomical.’

This book is graced by a fine preface written by Ulrich Pohlmann, a terse essay which surveys the artist’s life and makes a fine argument for the inclusion of von Gloeden’s photographs in the museums of the world. And then come the actual jewels – sepia toned moments of classicism using the working class Scilian youths for his Golden Mean models. Many of the photographs very comfortably present full frontal nudity of these young men and with the sexual revolution of the 1960′s these photographs abounded in books and calendars in support of the New Male Image. Following his death in 1931, von Gloeden’s collection of over three thousand glass plate negatives were left to his long time friend and model Pancrazio Buccini. When Mussolini’s Fascists entered Taormina in 1936, the negatives were seized, and Buccini was accused of “keeping pornography.” Though Buccini was acquitted, the negatives were not returned until after World War II. Very few of the plates survived; most of what we know of the Baron’s work has come to us from the collections of his admirers. But for whatever reason history will alter their use, these beautiful creations are true milestones in figurative photography.

The adult magazines and DVDs found in Jackson’s possession noted release dates from 1991 up until September 2003 (the actual search took place in November 2003) and were all legally and commercially produced heterosexual material. Most of them were found in Jackson’s nightstand, in a box at the base of his bed and in a briefcase in a closet in his bedroom. The prosecution spent days displaying the magazines that they had confiscated from Jackson’s bedroom on a big screen. [5] Observers wondered what point they were trying to make with the detailed, graphic presentation of this completely legal collection that only pointed to Jackson’s sexual interest in women, other than perhaps trying to publicly humiliate him and prejudice the conservative jury against him in the absence of real, relevant evidence.

Prosecutor Tom Sneddon in his closing statements even attempted to claim that the legal adult female models in some of Jackson’s pornography could actually secretly be under age and therefore suggested that these magazines could be considered child pornography; criminalizing not just Jackson but the makers of those magazines and anyone who owned them:

In reality the most common type of pornography available online and in print is “barely legal” themed,but his comments  revealed the desperation in the prosecution’s case, showing that Sneddon understood that nothing they had revealed in Jackson’s art or pornography collection was incriminating so in order to bolster their case they had to criminalize even his regular pornography.

The juror’s themselves later stated that they were “puzzled” regarding the inclusion of all these items, juror Hultman said after the acquittal, “…because those are adult magazines, and anyone can own them. It doesn’t prove the charge.” [LA Times, June 15th 2005]

In the 2005 search police also confiscated sixteen computers from Neverland, including three computers (which contained four hard drives in total) from Jackson’s bedroom, and sent them to the FBI for a forensic examination of their hard drives. None of the computers contained any illegal material or had any traces of access to illegal material on the Internet, including no attempts to find such material.

Once again, only legal adult heterosexual pornography was found cached in his hard drives from 1998 through till 2003, and according to court transcripts, the majority of these were photos of topless women.

As defense attorney Mesereau stated in his closing statements there was:

No illegal child pornography, either in a website or anywhere else. No websites where you try to meet children, like pedophiles often do, and the rest.”

Court transcripts showed that people who used Jackson’s computers visited Times magazine pages, pages relating to sports, Disney sites, toy stores, a site featuring “The FunniestGrudge,” which was a joke grudge match featuring Jackson and the musician Prince, and that he had allowed others to use his computers, including friend Marie Nicole Cascio who had used it to look up internet recipes. They also managed to capture his then twenty something cousin Elijah Jackson (who sometimes went by the nickname “Marcel Jackson”), visiting hetero porn sites on one of the computers in Jackson’s bedroom the night before the police raid on the 17th of November 2003, when Jackson had not even been at Neverland for 3 weeks at this time. Again, the prosecution were attempting to find items relating to a “teen” theme, much in the manner of “Barely Legal” and other legal adult heterosexual pornography, and as can be seen, these were only a small portion of the adult heterosexual imagery found on these computers. The #344 Sony Vaio for example reportedly contained 1700 cached erotic images [March 23rd transcript], but it appears none related to the Barely Legal theme.

The visits to the adoption sites on these computers were only cited in an attempt to show that Jackson had used these computers, as he had publicly stated on many occasions he would have liked to adopt children, and not that he was seeking them out for nefarious reasons, however they did show that whoever visited those sites had expressed an interest in adopting both female and male children. [March 23rd transcript]

All of this material was irrelevant to the charges and could not be directly linked to the prosecution’s case, so Judge Rodney Melville did not allow the prosecution to refer to this evidence in court. [5]
